If it dies when you put it in the car they will offer to sell you another.

I heard the dirt-bag husband, who represented himself to me as a cop, ended up serving hard time for something serious shortly after I met them... He had actually been a part-time private security guard at some time in the past, briefly... Eventual charges/prosecution/conviction(s) reputed to have stemmed from crimes committed during employment.

No surprise after the fact...

Shelley, all this could have been prevented with one clause: That all your guarantees are null and void if the dog is used for breeding before any hip and elbow certification and before turning 2 years old. In addition, I have a clause that these guarantees are not transferrable to a third party. Very important as well! And yes, my agreement is construed according to the laws of the state of Maryland (where we live). When I wrote my contract, I had a lawyer friend look it over.

Wow, it is awful what the wolrd has come to!  I have re-written my contract/sales agreement several times, and I still dont think it is perfect.  I worked for an attorney for over two years and learned how to word things correctly, etc.  I also learned that the simplier the better in a lot of ways.  But, I am still very scared of being taken advantage of by "dirt bags", as Shelley so politley put it!  Shelley, I would love to read over your contract to see if it has anything else that I should include in mine, if that is alright with you.  I have so far only had one incident with a buyer, and I think that the issue would have gone a lot smoother if they had found a REPUTABLE veterinarian first off!  (I plan on making a new thread about this issue!)

on the other hand, there are the breeder "guarantees" that aren't worth the paper they're written on. if the breeder doesn't hold up their end of the deal, it can be the prettiest guarantee in the world--but worthless. esp, as you said shelley, if the breeder's 2000 mi away and the buyer would have to travel that far just to FILE a claim in (usually) small claims court, much less travel again for the court date.

i learned an expensive lesson about "breeder guarantees" and breeders in general. i always say the best way to get someone's attention is to talk to their wallet. i was RIGHT!!!! :) :)

if i WAS a breeder though, i would have in the purchase agreement that the dog/pup had to come back to me if the original purchaser could no longer care for it. do you pros out there find this to be a helpful clause? do ppl return dogs to you or do they just blow off the contract?

As someone who rarely breeds and does GSD rescue, I can tell you it is not nearly as common as one might think that people return the dog or try to return it to the breeder. And I can also tell you that even though many, many breeders say they will take a dog back, it is very rare in my experience. One of the first things I ask when someone calls me wanting to dump a GSD is where they got it. I think many of you would be very surprised if I told you how often the answer to that question is from someone involved in the breed and/or in the sport of Schutzhund. In all the years I have been doing this, I have had a single breeder I contacted actually take back a dog. The others stalled and in the end, most just had excuse after excuse why they could not take the dog back.

I see this also with shelters. Most shelters I am familiar with have a contract which also states the dog must come back to them. Many times the people ignore this and call someone like me. I just cannot take all the GSDs I am asked to take. And all too often, the dog comes back with such problems it would not be adoptable in any case.

Well, first off I start with Limited reg. on everyone male or female,
and it they want breeding rights they have to have hips & elbows
OFA certified or pre-limbed.

That weeds out the people that are looking to breed.

I really haven't had a problem with people breeding and then wanting to return a dog.

Although I had 1 girl, that was sort of a friend but not really, get a female from me, and
talk me into changing the reg. to full, before she checked anything out.

Then, she starts complaining about her dog's behavior, and showed up on my door step,
with her dog, and it was missing an ear!
Her kids were with her & they had just got back from the beach, I didn't offer to take back the
dog, it looked as though it was extremely attached to the kids, and I'm sure it was a one family dog.
Other than her small children, and other animals, which includes a GSD with 3 legs, that accident
happened while she wasn't home, she said her dog jumped out a window 3 stories up.

Anyway, she was a whole lot of drama from the get go, so I have learned from her and many
other people, what I'm still not sure, I guess I can just say, I steer far away from drama.

I have taken back at least 4 GSD's that I can remember, one of them still lives with me, and tomorrow,
we are heading to a show,
he is  Theo Von Ryan, I'm so happy the lady returned him back to me, a bummer for her cause she was
getting a divorce, but the best thing that could have come my way.

Also, Bonnie Von Ryan, was given back to me, and I decided to keep her, that story is way too soap opera'ish to go into.

Life's too short, I'm outta here!

Shelly,  I'm scratching my head here, please set me straight if I've got this wrong!

These dirt-bags paid you cash for the two females they later returned, then they waited until you were out of the room, and stole the cash, is that correct?

Why didn't you sic the cops on them right away for grand theft? THEY STOLE THE DOGS FROM YOU!!

And since you never were paid for the dogs in the first place, why did you refund some of the purchase price when they returned the first bitch, the one that died??
