Sorry but if the dogs were loose and unattended why was it possible for anyone to gain entry in the first place?

Secondly, if the owner could see what was going on why could they not just recall the dogs or put them in a down etc?

The dogs were not under control, end of.

I've known of American Shepherds who had plenty of guardian ability.  The faulty-character story is, I think, greatly exaggerated (mainly by Euro GS nuts, not every-day people).  Their main problems are their bodies, twisted beyond reason.

For all of us who own shepherds this is bad news because our home owners insurance is going to start  not covering us or charging more for coverage. What happens when it is the guy reading the electric meter. What can we do about this or to help these people?

Over sensative?!  If some guy, some stranger grabs me and pushes me to the ground, and my dog DOES NOT bite him, I will put my dog down myself, this is not a joke.  This is not being oversensative, this is what a Quality GSD is supposed to do!

If the lady was already in distress from being pulled to the ground by the landscaper, and then she is screaming at the dog to stop biting the guy, is it really the dog's fault for not listening to her screaming?  I can only imagine that her yells for the dog to stop were as distressed as they were when she was pushed to the ground, a dog will not differentiate the two words, only hear the same tone of distress.

When the husband came out and called the dog off he listened.  This would not have happened if the dog was being AGGRESSIVE and UNCONTROLLED.

The dog protected his family, I am amazed at how many people on this list think this is the owners fault.

Many people are exiting New Jersey because of the highest property taxes as well as their horrible laws. This case is typical and will cost these people alot of money to fight this. This is not the first case I have seen of a Judge ordering a dog to be put down.

If my dogs are in my fenced yard I do not consider them lose. They are secured so they cannot leave the property.

Im not sure what to make of this as I would think that if you post , and  are insured,and the dog is not reported as a problem , and they enter private property and put there hands on a owner , then it seems that should be between the insurance and the intruder . My female will let you in and watch but if you pick-up your hand to reach out to me then it my fault ,if she goes for you , as I know that is her trigger. I thought that is what a PPD is, I have to admitt that now that I see this I would remove my dog before anyone got there , and there she would stay. No one is taking my dog ,or putting her down, she does her job with responsible restrain, that is her job.

KariM and Princess, you are right.  This dog was NOT oversensitive.  This family did everything right.  The husband told the 'intruders' to stay in their car untill someone came out and secured the dogs.  I would not want anyone on my property with my dogs loose unless I was out there.  I know if this had been me that my dog would have reacted the same, and I would expect him to do so.
