Where do you live....and where do they live?  If it's a state not too far away, then jump in your car and go get your dog.  Just give them their money back. (No need for AKC papers.) They don't like the dog..........why would you leave him there????  If you have to fly there........then do it.

Kelly----There's nothing wrong with a long thread discussing contracts and legalities........but in the end...it comes down to the pup's welfare. If it were me, I'd want him home.  Good luck. (Just remembered something.......aren't you subject to migraines?  Worrying about him is just asking for trouble.)

Kelly, thanks for more info. In this case , I would take the puppy back because you 'suspect' abuse and you agreed to take it back. Don't send them any money until you have received the puppy. If they don't like that,well, too bad. I think they are trying to pull a fast one on you. It probably is a fear stage but they don't sound reasonable to me so education may not work but is worth a try. Hold your ground. State your facts and wait. Either the puppy comes back ,at their expense,of course or it doesn't. This doesn't pass the smell test on their end. Why ask for papers on a pup you don't want? Another thing..there is a big difference between a purchase and a return. When you purchase something,you pay for it,then you get your product. When you return something you bring the product with you, the sales person examines it and then you get your refund.

I hope my last comment didn't sound like I was equating a puppy with a piece of non live goods. Just trying to make a point.

Kelly I agree with all the advice above. But most important try to keep your cool and be tactful with these people for the pups sake. What state is the puppy in? If you have friends or family or anyone you could trust with your money maybe they can go get  her and ship her back to you. Or find another suitable home for her. Explain to these people when something is purchased online , say ebay, you pay for the item. If it is not as described and is guaranteed you return it, usually at your expense, then a refund is given. This situation is no different. I would just not want  them to get mad and stop correspondance all together. Also if they have no interest in the pup they have no interest in the papers. That part makes no sense at all. gsdlvr2,  your point was very good.  It may be the way to explain to the people why their demands are out of line. 

 

Kelly Shaw,  good luck.  This really is the pits for you, and the pup.  Stay healthy yourself, it won't do any good if you make your self literally sick over this.

Kelly: As a friend of a breeder, I feel for you..my friend worries from dawn to dusk over these same issues...Do not refund any money, remember >the Malinda Julien thread,,,,,, it is so hard to make dog/puppy owners understand that they have responsibility of handling a puppy off of an airplane , the right way..They need help , but at this stage, wont probably want any suggestions as to how to take care of a pup , that is not in a good place.....No, 1.  You do not know how or what this pup has been exposed to..... no hair,????? why...stress brings on dermadectic, Have they had it to a vet? 2. Ask for a Health paper immediately....call them or email that....leave them in question that you may be sending for the pup....and need a health cert...immediately...dont make any promises....then ask for the phone nmber of vet. and want to discuss traveling....of course they have to get that to ship it......even if you are going to travel there......how far from you is this pup?

3. You may have to seperate your heart in this.......the grace period is up for returning a pup.....or for refund ....however if you go in person, offer a percentage for the trip which is their expense for returning the pup.......

4. Legal or not, it is costly to exercise any matters , out of state, or even in your town.....They dont need papers...dont fall for that ... 5.send them a copy of their akc papers so they cant say you are being dishonest , showing that you do have them and if they keep the pup, you will register it and name it, and put it in their name and send them the papers....I would also limit the registration.....do you have a clause in your contract for that....

6. Give them the name of a trainer in their area, and tell them to start socializing this pup and if it has all shots, take it everywhere.....try to reason with them.....and make it plain , you are not giving them a refund........and the only way you will take the pup back is in person, and they have to pay the cost of that.....good luck     my friend has the same issue again on this litter just sold out of Urbecke...grand son.....the couple had ocd issues and want her to buy back the pup , she delivered half way accross Texas two months ago....they love it and have already trained it in house, but they have a sick Mother in law , moving in , with them with a sick brother in law and have no time for new male puppy,, or have room in house for a jumping male pup, so she has to give permission to sell, which she did, and they can sell him   Too much money for people in Joshua , Texas....so they want her to buy him back.....found out they raise tiny breeds of pups, and who knows what this pup has been exposed to.....They have his akc paper, blocked, and have no problem giving all back....they dont want the full price, but the getting of the pup presents a problem, and the pup is in perfect condition ,according to them....they balked at the vet check, though , so my friend will not consider taking the pup back until that is done....cannot take a chance in bringing something foreign back into her kennel. they are desperate, they say for some money back as this has put them in monetary problems.....so there we all go again ,,,,,seperate facts, what to do for the good of the pup....this pup can be resold , but as a breeder. can you take back every pup you, sell, and start all over , and over...Im glad Im not a breeder, but I feel as I have bought all my shepherds from breeders that go thru this same issue every month of the year.....

give them the agreed-upon refund - you will need to discuss with them the amount - what does the contract say?  I would personally give them a full refund minus the deposit amount - I would probably pay shipping back unless they agreed to do that.  I would not send them the papers - why do that if the puppy is coming back to you anyway - that request makes me think they have other plans in mind for this pup - like selling it to someone else after they get your refund.  Keep the papers no matter what.   Main thing is, get the pup back so the pup can have a good home and be cared for properly - and deal with the people in a way that makes them satisfied with how you stood behind your puppy, so they don't bash your reputation all over the place for "screwing them".

This is one of a lot of reasons why I will never breed. again. As a breeder you do all you can to insure your pup goes to the right home but once they are gone you have no idea how the new owners are treating the pup.I was very lucky to find wonderful homes for my first and last litter.  I am glad you have the papers but the puppy is theirs and you can't make them give the dog back. You mentioned abuse but you need to have proof if you have proof I myself would do what ever I can to get the dog back. Looks like you are at the mercy of the owners.  Good luck and hope it all works out for the pup.

Now only time will tell when the owners are on here bashing the breeder.

God bless you Kelly, you have been through a lot lately. I don't know if this is feasable, but I would give them the money, in the form of a cashier's check, with a notarised document that states that receipt of this check constitutes the acceptance of an alternate contract, whereby they return the puppy, and endorsement of this check transfers the ownership of said puppy back to you...keep copies of everything, including the check, see if you can make some arraingement with your financial institute to be notified when the check is cashed, I would also send the sherrif's deptment or local police (local to the buyer & maybe local to you as well) copies of everything with a letter explaining the situation, and that you suspect abuse; if they cash the check without returning the puppy, that is fraud. Maybe make a few phone calls to agencies in the buyers area to see how much support you could muster from local authorities...sometimes you can find a sympathetic ear...I would probably pay the return shipping....it sucks, but the safety of the pup is tatamount............I am not a lawyer, so I don't know how well this could be implemented....it just makes me so mad to read about stuff like this...and who know what the poor pup's been through! good luck and best regards, jackie osborne

Kalibeck:   That won't work....The cost of legal fees to inforce that transaction will outweigh Kelly going herself to get the pup;.a waste of money, paper work and they will cash the mo and the sheriff and other entities dont touch legal or civil matters without a Judge issuing a proclamation....and that wont happen  They have done nothing wrong as of yet....No amount of money will insure you that if you sent money ahead they will give you your pup...Is he tatooed or chipped.....I wouldnt chance it.....they are playing their cards that you care so much so will fall for the game...If they are honest people, you got a payment and sent the merchandise,,,now they have to return the merchandise and get the percentage that you have offered...Its their loss and they have that responsibility...tHIS IS BUSINESS AS USUAL...KEEP IT THAT WAY...DON NOT GIVE IN.......YOU ARE A BUSINESS PERSON IN THIS .....

STAND FIRM AND THEY WILL RETURN THE PUP.   keep us informed  and we support your heart and your decisions....
