Also foregot to say,  did your friends mother take the puppy too late to the vets thats why it has a seizure as if it was cystitis this can be painfull, especially to a young puppy.   She should of took the pup straight away to the vets if something was not right.

AGAR, I believe there are puppy laws in Pennsylvania.

Agar - yes there is a puppy lemon law which applies to registered breeding kennels in PA.  Unfortunately if they sell less than (I think it is 26 dogs) per year, they are not held to it.  If it is a registered kennel, the breeder was required to either give you a copy of the PA Lemon Law or have it clearly posted so that you could see it.  Also, it does not require a pup be returned in order to receive reimburement if the puppy has been deemed sick, etc.  I believe you can expect to get reimbursement up to the value (paid) of the pup only.  Not all vet costs, etc. if they exceed the value paid for the pup. 

Also you state the breeder was in PA.  I would be interested in knowing where the pup was purchased, but if you are uncomfortable posting, would you please email it to me privately at Cherylshepherds@comcast.net?  I know some people who have had similar expereinces.

If there was no health guarantee to begin with, they were lucky the breeder even offered to refund their money, especially if it was a BYB.  It sounds like a sad situation but unfortunatly I don't see any reason to sue as the most they would get is the refund on their purchase price which the breeder already offered.  If there is nothing to be done for the pup, sounds like it would be cruel to do anything but euthinize.

Renofan2, here's what I know about the breeder if you wanna call them that....lol  they only breed 1 litter every couple years.  They have 3 females and a male.  The breeder is somewhere out in Portersville-Zelienople area but I don't know the name of the kennel.  I'm certain they sell less than 26 dogs a year. lol  I'm not even sure if this was a registered breeding kennel???  This was just altogether bad bad bad from the door.  It was a situation of clear "impulse" buying under emotional distress for my friend.  Her parents lost their dog after 14 years and they were devastated since this was the second dog they had to have put to sleep because of old age health problems in the past 2 years.  So my friend rushed out 2 weeks later and found the closest breeder who just so happend to have a pup that looked very similar to the dog they had to put down.  Although I sympathize with them that this whole deal totally sucked; I tend to have taken the attitude of "well, you knew 2 weeks after you got the pup that something was wrong-the dog should have gone straight back right then and there"; BUT since they felt the need to be vigilante's then I say suck it up now and hope for the best.  The shameful part of it all is by the time they finish paying vet bills to have this poor pup at best "stable" they could have bought themselves a kick ass titled dog that was healthy and already trained.  But it's too late for all that.  I passed on your information and I appreciate it.  I'm not sure what they will do.  I advised them to take the loss because they did have a choice but chose to keep the pup knowing this was gonna be an ongoing money pit.
