I'd just call him a dark sable.   How old is he?  If he's a "yout" his eyes will probably darken a little more still.

 Pic looks overexposed, and sun is directly in his eyes. I have pics of Caleb (who is solid black w/extremely dark eyes) taken at this angle that make him look this way, so while I see what you're saying, I don't think particular pic is a good one to use. I can't see his body, but his face would make me guess he's genetically a black and tan. Melanistic perhaps. Would like to see his body and back of head/ears.

I guess you could call him either a black and tan or a bicolor.  His registration papers could reflect either one.

 Can't see behind his ears or his underside to tell if he's bi or b&t. Melanistic b&t is my guess based on what I can see. Looks like some tan on his underside, maybe, and a true bi is black underneath and if there are marking on the face they should be tiny cheek marks and/or "eyebrows."

The redish tan bleed through on this dog's neck does not make him a sable.....Maybe a body picture would show if he was a true sable.... I have not looked at the link so I do not know for sure about his body color.....JMO

The headshot alone made me think sable.
Puppy pictures indicate he's either a melanistic B&T or a Bicolor.

Whatever he is, he's gorgeous.
Makes me wish I had time for one more.

Melanistic black and tan is the DEFINITION of bi-color.
