I'm with Bob-O; Sig Sauer 45, cocked and locked, and I will use it.
Yep, heard of this before, and actually had someone try to steal an entire litter before. That, and the fact that my husband is law enforcement, so weirdo people can come looking for him at any time. For all of these reasons, I do not use my home address on my website. Of course, despite having this knowledge, and letting ME be the one to decide who should be able to come to my house and who shouldn't, "someone" has made sure that everyone has access to my home address at this point, putting the lives of my family in danger from previous "clients" of the "felon persuasion".
We have guns and know how to shoot, but so do the "bad guys" who have already proven that they will use them on anyone who gets in their way, so this isn't always the reassurance that I used to feel it was. Also have dogs with teeth and big barks, but if someone is bound and determined to steal pups, and if they know you have them, and want them badly enough, not much will stop them. (previously stated by Bob-O!)
As Bob-O also states, the best offense is a good defense. Don't let everyone have your address where pups are kept, and keep a camera or alarm system with the ability to record WHO came to your house while you have been away. Another idea I came up with is to have everyone who DOES come to visit the pups at your house "sign in", and show a valid photo ID (write down the drivers license number). Most criminals will not want the possibility of being identified, and thus, you have a few less issues with potential problem-makers.
Having watched the video, I have to say, there would be no way in HELL I would let those two guys in my house unless my hubby (who is also in law enforcement) was home. Not to mention, someone would be out of their mind to steal German Shepherd puppies in front of any adult dog, as any one of my adult dogs would have given them a few injuries. I don't publish my home adress on my web or give out my adress unless I have spoken to the potential buyer and have made sure everything sounded right.
If you shoot anyone for trying to steal your dog here in PA, you will go to jail. If your protection dog tries to bite anyone trying to steal one of your dogs, you will go to jail and he will most likely end up labeled a dangerous dog, confiscated and usually PTS.
If someone breaks into your house to steal any item, this is breaking and entering. If they manage to steal anything, it then becomes burglary. If they use a "deadly weapon" (this does not just mean a gun) to threaten harm to or actually harm someone (who is afraid for their life) in the process, it is then an aggravated robbery.
Under NM state law, it is legal to shoot a fleeing felon.
HOWEVER, ultimately, if you shoot someone, and injur or kill them, you will be held accountable for your actions, so make sure they are justified.
Depending on circumstances, if you (say a 120 pound female, not knowing WHAT the person breaking in might be after--rape, killing you, etc., even if he does not have a weapon) SHOOT the intruder, yes, you will be held accountable, but I do not know of a jury on this planet that would sign a true bill for indictment of this woman. HOWEVER, if you are a 225 pound built man and some 15 year old scrawny kid without a weapon (key words!) breaks in, and you shoot him, you're probably going to do some time. This is just New Mexico law, however. It could vary from state to state.
IF your dog bites an intruder.....well, that would make for some interesting case law. A dog was defending YOU (or your property in your absence). There is not currently a law that makes an exception for reasons for an "acceptable" dog bite, but I guarantee you that if my dog bit someone, under those specifics, I would make sure the news media found out that they were trying to remove my dog and euthanize him/her and under what circumstances this was being done. The city/state government would not even want to deal with something that could easily end up with new case law and leaving them liable like that, so the dog would probably NOT be PTS, but of course, you can't count on it.
Good points to keep in mind, though, Blitzen!! :)
I lived in New Mexico for a few years and it is a liberal bleeding hearts State. Hers's a true story, a couple of hikers got lost in the mountains and after several days of searching they were spotted from the air. They were sending a helicopter to the rescue when the activist environment government people refused to allow the helicoter to land on the mountain because it might harm the landscape. The couple of people had to spend another night on the mountain to rescuers could reach them by ground. I could tell you more stories too.
In Texas if someone breaks in your house you don't have to ask for ID or a resume. You take care of business.
I was glad when I got transferred out.
In this area of Pa, the only dog owners who get away unscathed when their dogs bite anyone are the drug dealers LOL.
There might be a good case for a dog that bites an intruder who intend harm to a human, but biting one that broke in to steal a dog would be a different story here. The intruder would sue for damages and the owner's insurance provider would pay the bill and cancel the insurance. The offending dog would be confiscated and quaranteed for a period of time to make sure it didn't have rabies and then his future would be determinded by a judge who never owned a dog in his life.
There is even a ban in the city I lived in that prohibits police dogs due to their biting some criminals during a riot years ago. Yep, the bad guys sued the city and won and the dogs were retired. Go figure....
Dealer's dogs can run from their yards, bite a passer-by and that person will be cited for disturbing the the peace. This is not a dog friendly area by any stretch of the imagination. Instead of punishing the owners of the crazy aggressive dogs, they just enact ordinances forbidding specific breeds. The path of least resistance. Here the mayor would rather spend money on a baseball stadium to be build in a hgig crime section of the city than to hire more police officers. He calls it rehab.
Anyone living in a dog friendly area is very lucky. I think I'd rather live in NM than in PA. Shooting a fleeing felon here is not a good idea. The law would say if they are fleeing, there was no reason to shoot them as they were no longer a threat LOL.
Myself I would not shoot someone who was fleeing. But if in a dark place I would not take a chance if I could not tell.
"Shooting a fleeing felon"
Yes, there is a statute that states this. I don't, however, suggest it. LOL
Bleeding heart liberals is right....bummer for us who live here, DesertRangers!! You have NO IDEA how bad things have gotten...even worse than you were here, I'd wager!
They passed the "HEART" ordinance within Albuquerque city limits (The owner of any dog who is not sterilized must pay $150 PER YEAR for an "intact permit fee", and if your animal (hamster, dog, cat, whatever) has babies, accidental or intended, you must pay for a "litter permit" or "hobby breeder permit", another charge, prior to being allowed to sell or GIVE THEM AWAY. All animals must be kept in 60-80 degree temperature areas at all times (what happens in the summer when it rains, and your evaporative cooler does not cool your house?, even keeping them indoors would be illegal!), all animals must have toys to play with at all times (Yeah, this is a GREAT idea--let them chew something up and swallow it, get a bowel obstruction and need surgery...), no animal shall be "squirted with water at any time" (I guess bathing is out!), nor shall they be "teased or tormented" (this would mean if you don't allow your dog to bite the sleeve immediately, you would be breaking the law?), and birds must be given three perches, each a different diameter than the others (WHO is going to go measure all their birds' perches???), etc., etc. etc.)
They are currently trying to pass a state-wide bill making spay/neuter mandatory at 6 months, among other things. Once they start there, it's a slippery slope to the point where other things will start being yanked.
The only thing this bill does is hurt the law abiding citizens. Afterall, felons possessing a firearm is illegal to, and banning guns won't stop the criminals from getting or owning them--just the honest, law abiding citizens.
Sorry to have digressed so much from the original topic. I'll shut up now. LOL
My, doesn't the right to protect oneself, family and possessions vary from state to state? As far as I know, only Florida has what we call the "castle doctrine", i.e. a man's home is his castle and he has a right to defend it and all things within.
DesertRangers, one has to admire the Lone Star State with a great part of it remaining true to its frontier past. As far as I know it is the only state that still has the "but, he needed killing" law on the books, but still with a legal limit on how many criminals one can bag in one (1) day.
For the non-Texans who just read that last paragragh, know that I intend it as a joke! Even Bob has a sense of humour sometimes, however dark!
