What is the harm being done if the photo is used to inform and is factual? Are you worried about the artistic qualities and unique perceptions of the camera composition being unfairly attributed to another person? Or, that you are losing money from the way in which they use your photo, somehow?

Fair Use Test would apply on this site, I should think.

I post your photo on here if it is in my pedigree and you have not posted your dog on here so I can complete my pedigree...that is how we do it..to get our pedigrees complete...If I had the photo and it went to the dog I need to fill in the blank , it gets uploaded and it tells you under HISTORY who , me, posted it

 

I did not know we needed anyones permission to post your photo of your dog entered on this base..OUR administrators update photos and info all the time...that is their job..we want current info as much as can be found..WHAT would be your complaint ?

This is a Database....not a dating site.

If you want to change the picture , get busy and do it.. Your dog , your picture , change it...I am sure whoever put it there had the only pic there was ..If you like a different one , post it..follow the prompts and hit  UPDATE pedigree and go from there...

The picture has no copyright, that is the bottom line. It has an owner who put it in the public domain, said photo can be changed by the owner so there is no need to ask us to remove it.

People post picture thinking they safe, because technically they are right. You can't just take it and do what you want with it. If you post it to certain. Sites you are giving permission for others to use for that purpose. Sometimes you relinquish all rights by posting g. Photo contests are notorious for that.

But all photos have an implied copyright by the person that took it, until they relinquish it for whatever reason. That copyright is created the instant a photo is created. Its been that way at least since they restated it in the 1970s with case law.

Hey, it has been awhile since I brushed up on the copyright laws and since I am not in law enforcement or a lawyer I am excusing my posts, lol. :)  I think this falls under the fair use exception of this law and is why Oli is somewhat protected.

Fair use laws are actually quite limited.  The ones who have the greatest freedom are those who are using the pictures for educational purposes.  And when they do so are still required generally to mention the photographer as well as a link to the page that they got the picture from.  For the most part the safest way to use a picture is to ask permission and then abide by what ever conditions that the photographer has put on the picture.

The reality of the situation for the average joe photo shooter is figuring out your damages. If your photos are not worth anything, or the use of the photo is transformative ie. incorporated within an artwork, seeking damages is pretty pointless.

Using a photo with the purpose of illustration within a pedigree would also serve as a visual comment, and would be a fair use, too. I M H O

I have re-read the law and have spoken to the US Copyright office, before on this same issue. "Public Domain" and "Fair Use" does not excuse breaking Copyright.

Plus, most, if not all sites, will remove a picture if there is a complaint lodged against the use.   Quickly corrected.

I tried 3 sites to get my picture removed from and to this day all sites still show the picture. So, it may not be as easy as you might think. I even think google and yahoo show this picture in searches. It is so easy that is why there are millions of movies, albums, songs, software, streams and pictures being used on 1000s of sites every second of every day.

There is no sense for me(us) to remove this pic because it is easy removed by the owner of the dog.

The only sites I have ever posted photos is this one and my own FB breed board where I can delete them myself. Again, if you don't want to give access to photos, etc, don't post it to the net. It's not rocket science, it's common sense based on the world in which we live. Nothing is private anymore. Google your phone number and see what comes up. Unless you have requested that google removes it, anyone can see where you live and usually a street view of your home. Scary, isn't it?
