"P59, I have been advised that we are held to the same standard, as I mentioned earlier." Then you need to get your advice elsewhere. If a lawyer told you this, then he or she needs a remedial course in Administrative Law and should ask the professor for some extra help in understanding the concept of "legislative intent."

P59, I hold a licence from Oregon State Veterinary Medical Board, And work as the local municipal humane enforcement, ie. am the local "dog catcher" per the City and contract, further am the Humane society's appointed investigator. I get my information from Oregon State Statues, I don't beleive I was misinformed. I was also "Advised" by the investigators of the OHS who employ governor appointed investigators coving the entire state, I likely doubt they too would mislead me. And maybe the following Statue will make a few others here understand my position on this. SUMMARY Requires that certain public or private officials report suspected animal abuse. Relating to reporting of animal abuse; amending ORS 686.450, 686.455 and 686.465. Be It Enacted by the People of the State of Oregon: SECTION 1. ORS 686.450 is amended to read: 686.450. As used in ORS 686.450 to 686.465 and 686.990 (3): (1)(a) 'Aggravated animal abuse' means any animal abuse as described in ORS 167.322. (b) 'Aggravated animal abuse' does not include: (A) Good animal husbandry, as defined in ORS 167.310; or (B) Any exemption listed in ORS 167.335. (2) 'Law enforcement agency' means: (a) Any city or municipal police department. (b) Any county sheriff's office. (c) The Oregon State Police. (d) A law enforcement division of a humane society in Oregon that employs special agents authorized under ORS 131.805. (e) A law enforcement division of a county or municipal animal control agency that employs sworn officers. { + (3) 'Public or private official' has the meaning given that term in ORS 419B.005. + } { - (3) - } { + (4) + } 'Veterinarian' means a person licensed to practice veterinary medicine under ORS chapter 686. SECTION 2. ORS 686.455 is amended to read: 686.455. (1) A veterinarian { + or public or private official + } who has reasonable cause to believe that an animal with which the veterinarian { + or public or private official + } has come in contact has suffered aggravated animal abuse, or that any person with whom the veterinarian { + or public or private official + } has come in contact has committed aggravated animal abuse, shall immediately report the suspected aggravated animal abuse in the manner prescribed in subsection (2) of this section. (2) A report of suspected aggravated animal abuse required under subsection (1) of this section shall be made to a law enforcement agency, either orally or in writing, and shall include, if known: (a) The name and description of each animal involved; (b) The address and telephone number of the owner or other person responsible for the care of the animal; (c) The nature and extent of the suspected aggravated animal abuse; (d) Any evidence of previous aggravated animal abuse; (e) Any explanation given for the suspected aggravated animal abuse; and (f) Any other information that the person making the report believes may be helpful in establishing the cause of the suspected aggravated animal abuse or the identity of the person causing the aggravated animal abuse. SECTION 3. ORS 686.465 is amended to read: 686.465. A veterinarian { + or public or private official + } who acts in good faith and has reasonable grounds for making a report of suspected aggravated animal abuse under ORS 686.455 is not liable in any civil or criminal proceeding brought as a result of making the report. ----------

spook101, ya so full of it that I quote Oregon State Statues. spook, I went back and read a bunch of your posts and it seems to be your favorite thing to do... ie.. tell people how they "promote self importance" is this your way of feeling better ??? I don't think that quoting Oregon State Statues makes me full of crap so if that's promoting self importance, Whatever ???? Your odd !!

Ohhh and Spook you forgot to mention your crudentials... Please do tell all where you get your psycho babble ?? comics, cracker jacks, radio, 2nd grade maybe ?? Ohh I also forgot to mention I don't care what you think, I will sleep as usual in good concious knowing my efforts are in good faith. You just promote hate and discontent everytime you open your mouth/type a message. read your latest posts, Your mouthy and onry to everyone you have the slightest disagreement with. EVERY Single ONE !!!! Pattern here ???

(1) A veterinarian { + or public or private official + } who has reasonable cause to believe that an animal with which the veterinarian { + or public or private official + } has come in contact has suffered aggravated animal abuse," Did you come into contact with this animal?? ..." or that any person with whom the veterinarian { + or public or private official + } has come in contact has committed aggravated animal abuse,..." did DJC abuse an animal? shall immediately report the suspected aggravated animal abuse in the manner prescribed in subsection (2) of this section." "in the manner prescribed" implies that you have info as listed in (2) of this section, of which you have none, except third, fourth, fifth party hearsay on an internet messageboard... Calling and writing to USA might do some good if you present your position intelligently and are persistant. Dragging in HSUS and law officials does nothing good for anyone, as then everyone in this sport will be suspect.

I would change spook101's attitude, it's surlly and negative, not often lending people relevent or useful information. Always combative and staring crap for something to entertain him/herself with.
