I have been having some trouble getting my dogs registrations, so I called the AKC and gave them the information on the owner of the kennel and the supposed parents of my dogs. The sire Zeus de Eldorado and the dam Dutchess von Johnson are not even registered with the AKC. I know that I should have done my research but I really didn't have any knowledge of buying purebred dogs, anyways I intend of taking them to court over the issue does anyone have any experience in dealing with this situation? After letting the owner of Von Wyzal Kennels that I know that he is a liar, he told me that he does not wish to deal with me any longer and refuses to fulfill his contract.

I am sorry that you are going through this. But what are you hoping to gain from court? Are you trying to get your money back AND keep the dog you purchased? Or are you frustrated and hoping to cause the breeder some type of discomfort?

I am not really sure what I am expecting to get from court, it is not like they can magically create an AKC registration, but I would like to recoup some of the money I paid considering that I purchased him under false pretenses a dog with out papers is a mutt. I am sure that I could get all my money back by surrendering my dog but I love that guy and am to attached plus he is to attached to me and would not do well with anyone else. I would also like to cause the breeder a lot of discomfort.

Here is the pedigree of your dog (sibling?)

There are a lot of holes in it regarding health testing, registration..

 

Wyzal brokers a LOT of dogs that they didn't breed, although its possible this litter was bred by them.

 

Decide what you feel is a fair amount for your dog (without papers) and research how to proceed with a small claims court suit.

Oftentimes, you can reach an agreement with the seller, especially if you have a good contract to present in court.

Misrepresentation is when they agree in writing to provide regsitration papers, and then fail to do so.

Be clear you wish to keep your pup..

@DenWolf, I know of my dogs supposed pedigree the problem is that when I purchased my pup I was told that I would receive his papers. The problem arose when I spoke with the AKC only to find out that neither of his parents are registered, I had the AKC search by dogs name and owners name as well as see if the Von Wyzal registered any litters in the time frame my pup was born. How you put a price on a member of your family? I love my lazy dopey pup and I don't think that he would be able to be owned by someone else the dog is glued to my hip and wont go by anyone. To me he is priceless, but then again without his papers he is just a mutt, so what I guess like 200-300 bucks.

No he is just an unregistered dog, no mutt. By no means a serious problem if you love the dog.
Is it worth taking to court for $200 to $300?
Not meaning to question your intelligence, but are you 110% that those are the right names for the parents? I have seen a lot of people on here that can't find info and they have the names wrong.

@hntrjmpr434, yes I am 110% sure of his parents names. At this point it comes down to principle, I could honestly care less about the money but I do not like someone getting one over on me. Plus, since I have posted on a few different sites where they sell there puppies and have ran into quite a few others that are having the same issue. I would just like to teach them to a lesson.

Nick, that is a very fair and realistic value. I'd agree with you 100%, a "nice and sweet family pet" with no papers/proof of pedigree is worth about $300 in most places in this country.

Start with that.

I have seen pretty steep prices on Wyzal dogs, like >2K... 

You HAVE to put a value on the dog, if you don't a judge will.

 

In small claims, you have to prove that he/they/whoever sold you the dog AGREED to provide you with something that you paid for and did not receive.

Weigh the cost/is it worth it/principle of the matter with your time and cost to follow through with a small claims case.

 

What paperwork did you receive with the pup?

Is anything signed?  Do you have a written contract?

How did you pay, do you have a receipt for your payment?

Do you have any emails/texts/phone message recordings that show what was agreed by Wyzal??

 

Even if you have NONE of the above, you might still attempt to show that your price paid was excessive for a pet/unpapered puppy.

The more organized you are, the better your chance of prevailing.

 

If you paid in excess of $500 for that pup, and live close enough to where you bought it, then YES, I think it is worth your time and the small amount of money you would have to invest to take the case to small claims.

 

There is no way to tell for certain that the pedigree I posted is for sure your pup's, but since Wyzal entered it and several others in the line, its a good bet it is. Something somewhere went wrong, and somebody lied to somebody, and you paid the price. 

I am sorry for you, and wish you luck in resolving the issue...  it is good to know your pup stays with you regardless of outcome.

I`d contact Von Johnson German Shepherds - both dam and pup carry their kennel name.

@DenWolf The contract that I received was rather vague but it did list the parents on their, which are those on the pedigree above. The text messages that were sent between us state that the dog was able to be registered and that I haven't received my paper work yet due to DNA testing and AKC taking their time to process it. When I contacted the AKC they had no record of either dog. I did pay cash and it is on the contract that I paid in full at the time of purchase. The contract itself does not really help but our correspondence is where he opened himself up to being brought to court.

The pedigree that you posted is in fact my dogs as well, his littermates were 5 black and tan females and him a sable male.

@SUSIE, Good idea contacting von Johnson kennels but as a quick look at their page and it didn't show any of the dogs but it never hurts to ask.
