Donner i agree with you if a buyer is not happy with a certain clause in a contract dont buy or put a deposit down, go else where or ask the breeder to change it for you.

This is just for dramatization (Buyer = I want a Black and Tan male puppy with xyz out of this Male and that female.  Breeder = no problem boet they will be born on 28 February 2012.  Buyer = Great what do i do now.  Breeder = Give me the deposit and i ensure that your puppy will be ready for you to pick up by 30 April 2012.  Buyer =  okay great thanks here you go.  See you 30 April and please let me know when the puppies are born.  Breeder = No problem boet thanks.

Now either the buyer takes a pup from a different litter or he just looses his deposit and goes somewhere else.  What did this buyer do wrong except trust the breeder to give him what he asked and promised to get.

People get castrated on here for shipping people the wrong dogs or not sending papers it is all the same thing.  Do your business fair.  If you cannot deliver a product give the people their money back.

This person was explained EXACTLY how non-refundable deposits work and he was ok with it. He agreed to it and said he wouldn't mind a puppy from any of the possible breeding coming up that we had planned.  

He just decided to start screaming he wanted his refund back right after we had exactly what he had changed his mind to. He had origianlly put the deposit down on a female.

You can always say in your contract that the deposit is not refundable in the event the buyer changes his or her mind about buying the dog, refundable or applied to another litter in the event the breeder can't provide an appropriate dog - as agreed upon by all involved parties. If one only breeds a litter every year or so then it's probably smart to just return a deposit as a rule of thmb rather than make a person hang around for a year of more waiting for a dog.

IMO the main reason for returning a deposit to someone like this buyer is that the dog may not have the best home and there will most likely be many complaints for years to come. I'd rather lose the deposit.

Blitzen, That is exactly why I decided to return the deposit. Our puppies deserve better. Its a closed done deal!  Its behind us, but will always be kept close by in mind because it was a good lesson learned.
