ladywolf, just because you write in a clause into your contract that allows you punitive damages doesn't mean it is enforceable. As a matter fact it may weaken the more viable parts of your contract.

Contracts are only as good as the two parties involved and the item that is at stake. When you're talking about small animals, more than likely it is cost prohibitive to take the other party to court. Going to court as a matter of principle can make you broke very quickly.

Ladywolf, I had the same clause in my contract when I was breeding and had no problems at all getting my dogs back from buyers who decided they no longer wanted them. I got back about 25% of the dogs I bred and ended up keeping most of them.  There was one time that I couldn't take back a bitch the day the buyer wanted me to, I needed to build another kennel and asked for a few weeks to do that. A few days later, after I'd purchased the kennel material, she told me the bitch had been placed. A little research told me that she had sold her to an area puppymill. After that I took them back ASAP regardless if I had the room or not at the time. I tried to do the right thing when I sold my dogs by interviewing the buyers, visiting with the ones in the area, asking all sorts of questions, etc. and still got fooled.

Blitzen, did you ever collect punitive damages?

by Blitzen on 08 June 2007 - 13:06

No, I never tried to do that. Never had a reason to.

yellowrose of Texas,

If you don't mind me asking you this question.. (Note: I was going to send you a private email, however since you have your email blocked, I had not choice but to ask here in public) I assume you own the kennels vom Vielenbache? Right? Because I've googled up the kennel name and was brought to this website http://vielenbache.com/ (http://vielenbache.com/home.htm)

I've clicked GSD litters on the left side of the navigation bar and then clicked on the “J” Litters link. I couldn't help but to see that the parents of this Jeremiah dog are totally different, heck even the DOB is different. I did this not to start up an argument but to research the parents of Jeremiah and to see why they're listed up as being untitled on this site. I couldn't find out why because neither parents are on the website as we speak of.

Do you own the kennel http://www.triplhgermanshepherds.com by any chance? Why would you use a different kennel name for Jeremiah?

Hi Ms. Rose.  Is this von vielenbache their actual kennel name, or has he stolen it from a legitimate kennels?  There are many listings for a von Vielenbache online.  There is also a thread concerning this kennels on Leerburg.com, dated 2/07.  I'd appreciate a private email from you giving me the names of these people that purchased the puppy from you, so I can avoid them myself.

No, as I understand it, Brit, they changed the puppy's name to von vielenbach.
