In the case of a bullet fired at a precisely vertical angle (something extremely difficult for a human being to duplicate), the bullet would tumble, lose its spin, and fall at a much slower speed due to terminal velocity and is therefore rendered less than lethal on impact. However, if a bullet is fired upward at a non-vertical angle (a far more probable possibility), it will maintain its spin and will reach a high enough speed to be lethal on impact. Because of this potentiality, firing a gun into the air is illegal in most states, and even in the states that it is legal, it is not recommended by the police.

I maintain that if it was a .22 even from a pistol, a determined to injure your dog pit bull would not have even noticed. Either he was not in serious intent on your dog or it was not a pit IMO. My personal dogs ignore most gunfire but will look up if we fire off the .44 automag. Could be we also rarly shoot that one as it takes a cut down 308 rifle caseing to make each bullet. We mostly only display it only when someone that has never seen flames out the side ports of one visits and are a gun enthusiast.

Regardless it truly is up to us to protect our dogs. The best protection is loose dog laws and doing what we need to do to protect our dogs. A walking staff or bear spray are my personal favorites.

I had something similar happen to myself about 2 months ago...Also live in a rural area; I am surrounded by corn and hay fields. I do have a fenced yard, and my dogs are all well socialized. However, there was an incident one day with my neighbours dog while I was walking in the field. Long story short my female got an ear injury and their dog ended up with a gash from shoulder to shoulder...

Basically as others have said- its stems from a challange being made and one dog not backing down.  Earlier that day my female was  in town with my friend and I- there were 6 dogs total with us and we even met a few on our walk, she is well socialized. However, when the neighbours dog  saw us in the field she literally beelined as fast as she could barking and growling the whole entire way. My female perceived the threat and acted on it....
It didnt end up good for the other dog but you know what...they were warned. I have had ongoing issues with that dog ever since I moved in.

Anyway, I did speak to a cop about the incident and he said if a dog ever goes on your property with intent to harm, you may discharge your firearm and bill the dog owner for the cost of the bullet.
