Was hoping maybe someone could shed some light on what has turned into a painful situation.

Long story short I bought GSD from what I thought was a reputtable breeder in August of 07.  Checked references etc...

Turned out she does NOT own the stud she claimed to.  And she was never able to provide AKC papers.   When I would ask she would say dont worry you will have them by the time you get your BH.

Never once mentioning that she did not own the dog infact all along insinuated she did as it was in her possession.

But recently the owner who is a Sheriff in Virginia actually registered the stud with the AKC. She did not tell me I was doing research and started to find things out etc...

Is there a chance I can get my Bitch registered?

Have the contract of sale which indicates that my dog will be registered with the AKC within 1 year. Which in hindsight should have been my first clue.

I cant be bothered with all the bad energy or Karma that is going on with this person. The more research I do the more corrupt and disturbed I find this breeder is.  I will chalk it up to a life lesson that cost me almost 2k.

BUT>>>>>>

Just looking for any insight like can the AKC issues papers without the Stud owners consent on the litter?

THANKS!
Happy New Year!

You will need the Stud owners consent.  Why can't you just contact him if you know he is the Sheriff and where to locate him?  He may not be happy with the breeder who had his dog, might not even know your litter exists, but he should be willing to help you;  you were innocent in this matter.  I would start by calling him today.

3crzygsds,

Thats a big bummer.

The only diffinate thing I know you can do is get an ILP (Indefinite listing privilege) through AKC but I believe if you do that the future pups of your bitch (if your going to breed her) would not be allegeable for AKC registration. So I guess another thing to think about is do you simply want to compete or do you have hopes for breeding her. If you just want to compete i would say forget the breeder ,get your ILP, and go have fun.

Hmmm... well just to be on the positive side, maybe now that the sheriff has gotten his dog AKC registered the breeder will get the paperwork done so the litter can be registered. If the sire was an import it can take awhile to get the paperwork from another country. I think as long as the Sheriff owned the dog (and signs the litter appl.) at the time of mating it is do-able. It also seems the one year contract was up in Aug. of 2008, so I guess if it were me and she does not fulfill the agreement  on her own now that the stud is AKC registered I would 1) contact again and make every effort to work it out 2) if this did not work, I would contact the owner of the male and find out if he knew his male was used and ask if he would sign the paperwork (you would need her signature as well on the litter appl. too) 3) if none of this worked, I would go directly to the AKC with the contract agreement (seems they have some new thing on registering about anything with AKC papers) 4) lastly you could try to file a claim in Small Claims Court to recoup some of your money. You don't need a lawyer and I think can request up to $3500.00. But even if you win it is a pain to collect it I think. So best to try to work it out with 1-3 suggestions.

Someone wrote earlier this year , that AKC has some new rules...If you buy a pup and both parents are registered and the seller fails to give you papers , you contact akc for the proper papers and proceed how they tell you to do...It was indicated that akc will register any pup if both parents are registered and you have a problem with the seller...Dont remember who posted that but maybe some one can shed the light...

Call AKC and ask to speak to a person in the Case Management Department..They will ask you to submit in writing the numbers and the bill of sale and the problem you are having..GO  ahead and get that prepared in writing and get it notorized and ready to fax to them  Them make copies and send by mail , with return receipt...Make copies of all...Akc will get to the problem . May take a while, but you have to submit in writing the problem , in detail , and make copies of all correspondence, contracts, bill of sale , etc and send copies with your letter...

A pain in the butt, but you must do it..Then the breeder will get  hers or his letter of determination and from there you may see some squearming and some attention to getting the papers.,If there was some crookedness going on,,you  have at least reported it to AKC and if my memory serves me, the posting said AKC takes it in their hands and issues you a registration.

If you paid that much for a pup, I would insist, and you have the right , to demand a DNA on your pup , in writing by a certified letter to owner of litter and the male concerned., to prove the father of the pup you bought..I would..I would never sit by and not go the full circle..How do you know that pup is out of that dog she says..,especially now that time has elapsed and the studs owner is not coming forth with papers or a registration in your hand by now...Never buy a pup without seeing registration papers  .

Good suggestions only thing I would clarify is that if you are going to go the ILP route the dog MUST be spayed/neutered.  You have to show paperwork from your vet stating that it was done.  I have gone that route several times with dogs I own and its pretty quick and easy to do you just send in the application, photos of the dogs, proof of neutering and fee, usually you hear back from them in a few weeks.  Just depends on what you want to do!

The litter was never registered.

Go back to the breeder first.

I agree, call AKC and let them give you advice.

And if what you say is true feel free to give the breeders name in public.

Good luck with it.

Yikes AMY      Pay over 2000.00 and spay or neuter your pup to get an AKC registration..Id take her pretty little body to court in a minute...Small claims court and if there is some lieing going on , criminal charges can be filed on a breeder that sells a pup without papers if paperwork states it is registerable. Especially if the Sheriff is involved with owning  the stud..Boy, what people get themselves into...UNBELIEVABLE.

FILE CHARGES ON THE BREEDER...I WOULDNT SIT IDLY BY IF I SPENT THAT KIND OF MONEY ON A PUP AND NO PAPERS...NO WAY...GET BUSY AND GET FILED BEFORE A TIME LIMIT RUNS OUT...THE SOONER THE BETTER.

Judges are famous for asking you    WHY DID YOU WAIT SO LONG TO FILE THIS????? So dont be guilty of that...Do it and if the breeder comes forward with the correct papers, she knows you're serious....talk does nothing now a days...Filing charges gets action.

To go through AKC would require she has both parents name and reg.#.I bet she does not have that .AKC does require that information to be passed to the purchaser at the time of the sale, if AKC papers are not given upon receipt of the dog. With out that info.it will be hard to proceed with AKC.No I am not the person this thread is about..This is just my 2 cents..

wuzzup I am thinking (hoping) she may have this info because she has a contract of sort staing she would have AKC papers before a year was up. The year should have been up by Aug. 2008 or at the latest when the pup was sold at 8 weeks making it Oct. 2008.

YR wasn't  there something about the AKC letting people rename their dogs (taking off kennel names) and also changing the status from Limited Papers to Full Papers? I thought people were in a uproar over the later and the only solution was to register the whole litter yourself. I agree with the DNA but would go the court route only has a last ditch effort. Mostly because even if you get judgement for you, you have the responsibility to collect what is given to you, not the court. So seems your in the same boat as you started. I think there is something you can file but it is a pita.

Trailrider I hope you are right! It just seems to me if a person sets out to screw you over they will not be so forthcoming with any info for you to screw them back. Some contracts can be loosely written and someone not familiar with registration rules is an easy target for a scam.

3crzygsds, so far we know that the sire was not registered with the A.K.C. when this litter was born, but he is now registered with the A.K.C.. But I have read nothing here that assures me that the dam is A.K.C. registered.

Was the litter produced with the full knowledge of the current sire's owner? We don't know from what is written here. Can it be proven that this is the sire who was used? Yes, through the submission of DNA samples from both the sire and your bitch puppy. The DNA sample from the dam may not be needed if she is already registered with the A.K.C., but in your unique case I can't say. The A.K.C. may demand a DNA submission by the dam's owner in light of what has happened.

I think it is absolutely possible to register this bitch puppy with the A.K.C. provided that both the sire and the dam are A.K.C. registered. It sounds as if the sire is foreign-born, and since he is now A.K.C.-registered, a sample of his DNA was provided.

Following the statements by Yellow Rose; the owner of the sire and the owner of the dam must both sign the litter registration application before any of the individual puppies can be registered. I know that the A.K.C. charges a higher fee for a late registration in order to push breeders to complete the paperwork in a timely manner.

Wow, this is something else, and I think it will easily take as long as twelve (12) weeks-at minimum, to straighten out this mess. I continue the advice from Two Moons' previous post-first go to the breeder and ask what she plans to do, and when she plans to do it. I would give her the first chance to mend her error here. But, I also asvide you to contact Case Management at the A.K.C. and ask them in a hypothetical way; how could this case be handled? This will let you know if the breeder is being truthful as to her progress. In closing, do let us know what happened.

Good Luck, and Best Regards,

Bob-O

wuzzup yeah your right on if people set out with the intentions of screwing you over. For her sake I just hope it took longer to get the stud AKC registered than was originally planned. Hope the OP keeps us posted on the outcome...

Wow thanks everyone great advise.

I did ask for the DAMS AKC # but got no response she does have a SCH1 and BH but that does not mean she is AKC registered.  Also someone made a great point I have no way to know that the stud she said is her father is.  She has told so many tales who knows what is what.

At the end of the day I was  lied to and a fraud was committed.  Never would have paid what I did for a dog with no papers.

I have asked the breeder over and over.  Only did she admit about the mess when I figured it out after an investigation basically googling (lol).  The Detective from the Sheriff's dept that recently registered the dog has been so bitter over this event he would not do anything for anyone associated with this breeder.  Although he is starting to come around.

The last I heard from her was October and this is the response below....I have been in contact with the AKC there is NO claim as she stated below and I will be filing a dispute with the AKC.  The crazy thing is this breeder will get on this very website and talk sheet which is complete insanity to me.  HELLOOO people in glass houses should not throw stones lol!

Please give me your feed back on her email below.

Due to legal protocol and AKC's obligations, we were forced to wait until a certain date to give Daniela Huppe a chance to re-appeal the case (which she promised both AKC and SV she would be re-appealing, but didn't.)

I am sure you've heard all by now...... So there is absolutely no need for me to go into any fine details at this point. If you'd like more details and information feel free to contact my attorney  - He will bill you directly for his time.  Or you can stay in contact with me directly and I will continue to give you updates, as they happen.

Somewhere between what she says the importer says is the truth,  she was given the stud for 1 breeding according to the importer than the dog was to be delivered to the Detective. WHO has a bill of sale and registered the dog only 2 months ago.  Again all of which I found on my own none threw breeder.

I have a lawyer he sent letters to her and her lawyer and they asked for patience! It has run out.

Hello Carolyn McCarthy,

As I am sure you know....this is Kimberly Wiacek-Richards with von Hayden German Shepherds where purchased Voxi von Hayden from.

I'd recommend if you are going to expose information, expose the entire truth and all the facts not just part of them and lies. You are absolutely correct you don't have AKC papers on Voxi due to Daniela Huppe being a scam artist!

For anyone who'd like to read the entire story about the situation feel free to read http://vonhaydengermanshepherds.com/unfortunateevents.html don't hesitate to contact us directly via eMail @ vonHaydenSheps@gmail.com if you have any additional questions.

As I told you previously we are doing everything in our power to get your registration papers for Voxi.  We have completed our lawsuit against Daniela Huppe and now working with the appropriate departments to get this ironed out, once and for all.

Jonathan has nothing to do with this dog, so leave him out of this situation. He doesn't need the drama your going to drag in his direction.  For the record Jonathan is not the registered owner of Nando.

If you want your Limited AKC papers (as you did purchase her as a pet) then you should really ask your friend Daniela Huppe to help you, since you have explained on several occasions that you speak with her often enough. In the meantime I will continue to fight the battle of getting these puppies registered, so that I can fu fill my obligation to you and other puppy owners.

No, I never denied papers to you or any other owner, instead I filed suit to ensure I did everything absolutely correct, so that getting the AKC papers would be possible and legal.

There is absolutely no need for me to go into any fine details at this point, but if anyone has questi

DH is very bad news and the information posted here about Voxi is not factual.

DH has ripped off Kim of Von Hayden Sheps more than Kim can EVER describe.   Daniela Huppe continues to call AKC with  lies about this matter spreading lies wherever people will listen to her... even after Kim was awarded a court order proving her ownership and more on this and other dogs,   Kim continues to have difficulty obtaining rightful paperwork on the resulting puppies produced due to her association with Daniela on these dogs.

Check this out...
Here's another link which describes the fraud DH has done to me as well...

http://www.schraderhausk9.com/gesi%20story_purchased%20from%20Daniela%20Huppe%20_.htm

SHE IS BAD NEWS...Definately Buyer Beware
