bought an 8 month old female thru a broker in bulgaria. waited until she turned two and did her xrays . she is dm neg/neg and she is fair in hips and dyspastic in elbow  grade 2.     so who is responsible for replacing or refunding?  the breeder seller or the buyer importer who sold her to me?????

If you wanted a guarantee that the dog would pass all health screenings, the time to inquire about that was BEFORE you parted with any of your money, and you would need to have gotten that guarantee in writing and signed by whichever party was extending that warranty--could be the breeder, or it could be the broker.

Most likely, however, there was no guarantee--if you had one, you wouldn't be asking 'who is responsible', because your written contract would spell it out quite specifically--so I strongly suspect you're out of luck in that respect.

Just a suggestion--If you're trying to purchase a potential breeding candidate, and want to be certain you'll get a dog that passes hip and elbow certification, you need to be looking at dogs that have already been certified, and not those who aren't old enough to be certified. It will be more costly up front, most likely, but in the long run you won't have to go through several dogs until you have one that clears in all respects.

Buying a Puppy or Young dog out of your own country can be a problem IF you don't know the people your buying from...even if you know them it can still be stressful...
If say you're in the U.S. and buy from overseas...It's difficult to get much satisfaction from people you don't know...
If you were wanting something in particular then you should have had a contract stating that but even then from overseas it's difficult...
I've been in the dog world for a long time and it still amazes me that people want a puppy...Why...Mainly because it's cheaper then an older dog...But then they want every guarantee under the sun...It just doesn't make sense to me...
Like was stated above...If you want something special and want to be sure you get that...then get a young dog or adult...then you can have whatever tests you want and you have your guarantee...

I agree with the other responses as they all make good points of the issue
and unfortunately its very difficult with guarantees overseas, unless its in
writing.
many kennels in Europe sell their puppies cheaper because their giving no warranty. However, their
are a few Good Brokers here in the USA that Import from Europe and charge a bit more, but warranty
the dog or puppy for you. I found that Euro-americank9 in New York & Florida and also CPI in Mass.
offered extended multiple year warranty's on dogs and puppies if you followed their recommendations
and also allowed you to keep dog with problem, which is rare.

A few of todays better Brokers / Kennels are really looking out for their clients
and stepping up their warrantys....in return your paying a little more , but I think of it as a good insurance policy.
